Additional terms for KASPR Schedule
The sections below apply to the KASPR Schedule service at schedule.kasprdata.com (the "Service"), its pages, data, predictions, maps, scores, recommendations and any other output (together, the "Outputs"), and to every account, whether opened with an email address or through Google. They apply in addition to the terms above. Where they conflict, these sections prevail for the Service.
Acceptable use
You may use the Service and the Outputs only for your own, or your organisation’s own, internal planning of calls, sessions, posts and campaigns, through the pages we provide, in the way an ordinary visitor would.
You must not, and must not allow or assist anyone else to: (a) scrape, crawl, spider, harvest, mine, or otherwise collect or extract any Outputs or other content from the Service, whether by bots, scripts, headless browsers, browser extensions, automated tools, or by repeated or systematic manual requests; (b) copy, reproduce, download in bulk, store, cache, archive, aggregate, compile, or build a database from any Outputs, beyond the ordinary operation of your browser; (c) sell, resell, license, sublicense, publish, redistribute, share, or otherwise make any Outputs available to any third party, in whole or in part, in any form, including through another product, service, report, dataset, or publication; (d) reverse engineer, decompile, infer, reconstruct, or attempt to derive the underlying measurements, models, parameters, thresholds, or methodology behind any Output; (e) use the Service or any Output to develop, train, fine-tune, benchmark, calibrate, validate, or improve any product, service, dataset, index, or machine-learning model, including any competing product; (f) circumvent, probe, test, disable, overload, or evade any rate limit, usage allowance, authentication, access control, or other technical measure, or access any endpoint, feed, or interface that is not the ordinary page interface we present to signed-in or public visitors; (g) open or use multiple accounts, email addresses, Google accounts, IP addresses, devices, or identities to obtain more access, more lookups, or more data than one account is allowed; (h) share account credentials, or let another person use your account; (i) remove, obscure, or alter any notice of ownership, provenance, or vintage shown with an Output; or (j) use the Service for any unlawful purpose or in a way that interferes with its operation or with other users.
Data and Outputs
All measurement data, predictions, maps, scores, recommendations and other Outputs, and the models and methodology behind them, are the property of KASPR Datahaus PTY LTD or its licensors and are protected by copyright, database rights, and other intellectual property laws. Nothing in these terms transfers any ownership to you.
Subject to these terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to view the Outputs through the Service and to use them for your own internal planning. No other right or licence is granted, whether by implication or otherwise. The licence ends when your account is closed, when you breach these terms, or when we end the Service or your access to it.
Outputs are predictions of typical patterns from past measurement, not statements about live conditions and not guarantees of any outcome. You rely on them at your own risk.
Accounts, the beta, and limits
One person, one account. You must give a working email address that you control (or sign in with a Google account that you control), keep your access credentials to yourself, and tell us if you believe your account has been used without your permission. You are responsible for everything done through your account.
The Service is offered as a beta. We may change, limit, suspend, or withdraw any feature, allowance, rate limit, or the whole Service at any time, with or without notice, and we may close any account, including for inactivity.
Usage allowances and rate limits are part of the Service. Reaching a limit is not a fault; attempting to get around one is a breach of these terms.
Monitoring and enforcement
We record requests to the Service, including addresses, accounts, and the pages and places looked up, and we use those records to operate the Service, to enforce these terms, and to investigate suspected misuse.
If we believe, acting reasonably, that you have breached these terms, we may at our discretion and without notice limit, suspend, or terminate your access and any account associated with you, and remove any data you have submitted. Any licence granted to you ends at once. We may also take legal action, and you agree to indemnify KASPR Datahaus PTY LTD against any loss, damage, cost, or claim arising from your breach, including the cost of recovering or preventing the misuse of Outputs.
These rights are in addition to any other right or remedy available to us at law.
API and automated access
Automated or programmatic access to the Service or its data — including through any API, feed, export, bulk file, or integration — is permitted only under a separate written agreement with KASPR Datahaus PTY LTD and with the credentials we issue for it. Any other automated access is prohibited. To ask about an agreement, write to info@kasprdata.com.
Changes to these additional terms
We may update these additional terms from time to time. The date at the top of this page is the date of the latest version. Continued use of the Service after a change means you accept the changed terms.
Additional terms for the KASPR Predict MCP
The sections below apply to the KASPR Predict MCP: the Model Context Protocol servers at mcp.kasprdata.com (including the timing server and the scheduling server), the HTTP routes they expose, any local or on-device version of the server software we make available, the keys we issue for them, and everything they return — verdicts, bands, confidence levels, suggestions, alternatives, recommendations, windows, holds, tuning parameters, forecasts, explanations and any other output (together, the "MCP Outputs"). They apply in addition to the terms above and to the additional terms for KASPR Schedule, which apply to the MCP as if it were part of the Service. Where they conflict, these sections prevail for the MCP.
Keys and acceptance. A key is issued only to a person or organisation that has accepted these terms. Using a key — directly, through an MCP client, through software you run, or through an automated agent you configure or operate — is your acceptance of these terms on each occasion and on behalf of the organisation whose work you do with it. If you do not agree, do not install or use the MCP and return or destroy the key.
What the MCP Outputs are, and are not
The MCP Outputs are statistical statements about how a place’s internet connection has typically behaved, hour by hour, in past measurement from a frozen data vintage. They are not measurements of current conditions, not forecasts of any specific event, and not statements about any particular network, provider, device, route, or person. A verdict that an hour is "steady", "mixed" or "congested", a suggestion to use a different hour, a decision to run now or wait, a hold, or a tuning parameter is a tendency expressed in words, and nothing more.
The MCP Outputs are not professional, technical, operational, financial, medical, legal, safety or other advice, and are not a substitute for your own judgement, testing, monitoring and planning. Actual conditions at any time and place may be different from, better than, or worse than anything the MCP Outputs say. Timing suggestions may be wrong, stale, incomplete, imprecise, or unavailable, and a suggested hour may turn out worse than the hour you proposed. The MCP may answer "no recommendation" when a better hour existed, and may suggest a change when none was needed.
You must not use the MCP Outputs as the sole basis for, or allow any automated system to act on them without human review in, any decision where an error could cause death, personal injury, property damage, loss of data, financial loss, a missed legal or regulatory deadline, or any other serious harm, including emergency, medical, safety-critical, security, financial-trading, or legal matters. Any such use is entirely at your own risk and in breach of these terms.
No warranty
To the fullest extent permitted by law, the MCP, the keys, the server software and the MCP Outputs are provided "as is" and "as available", with all faults, and without any warranty, condition, guarantee or representation of any kind, whether express, implied, statutory or otherwise, including any warranty or condition of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, completeness, timeliness, reliability, availability, non-infringement, or that any output will be correct, that any suggested hour will be better, that the MCP will be uninterrupted, error-free, or secure, or that defects will be corrected.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law. Where such a guarantee applies and our liability for breach of it cannot be excluded but can be limited, our liability is limited, at our option, to supplying the relevant services again or paying the cost of having them supplied again.
Limitation of liability
To the fullest extent permitted by law, KASPR Datahaus PTY LTD, its directors, officers, employees, contractors, licensors and suppliers are not liable to you or to anyone claiming through you, under contract, tort (including negligence), statute, equity or otherwise, for any loss or damage of any kind arising out of or in connection with the MCP or the MCP Outputs, including any decision made, action taken or not taken, task run, deferred, moved or cancelled, call, session, broadcast, upload, transfer or job that was delayed, degraded, failed, rescheduled or missed, any cost of waiting, any retry, timeout, provider charge, token or compute cost, or any reliance on an MCP Output, and including any indirect, incidental, special, consequential, exemplary or punitive loss, loss of profit, revenue, business, opportunity, goodwill, data, or use, however caused and even if we were told that such loss was possible.
To the extent that liability cannot be excluded, our total aggregate liability to you for all claims arising out of or in connection with the MCP and the MCP Outputs in any twelve-month period is limited to the greater of one hundred Australian dollars (A$100) and the amount you paid us for the MCP in that period.
You agree that these exclusions and limits are a fair allocation of risk given that the MCP is offered free of charge during the beta, that its outputs are statistical tendencies by nature, and that you remain in control of every decision.
Automated agents and clients
You are responsible for every MCP client, agent, model, script, pipeline or other software that uses your key, for how it is configured, for what it does with the MCP Outputs, and for every action it takes or does not take as a result, as if you had taken that action yourself. You must not configure an agent so that an MCP Output can, without human review, cancel, block, delay or trigger anything whose failure could cause serious harm.
MCP clients such as Claude, ChatGPT, Cursor and others are third-party products that we do not control and are not responsible for. How a client presents, paraphrases, truncates or acts on an MCP Output is between you and that client’s provider.
Acceptable use of the MCP
In addition to the acceptable-use rules of KASPR Schedule, which apply to the MCP in full, you must not, and must not allow or assist anyone else to: (a) use the MCP or the MCP Outputs to build, train, calibrate, benchmark, validate or improve any product, service, dataset, index or model, including any competing timing, scheduling, network-quality or connectivity product; (b) resell, sublicense, publish, redistribute, or make the MCP, a key, or the MCP Outputs available to any third party, including as or within another service, agent, product, report or dataset; (c) enumerate, harvest or systematically query places, hours or outputs beyond the ordinary planning use of one person or team, or circumvent any cap, allowance, rate limit or the geographic-spread rule; (d) share a key, embed a key in client-side or public code, or use a key issued to someone else; (e) probe, scan, stress, reverse engineer, or attempt to reconstruct the measurements, models, thresholds, parameters or methodology behind any MCP Output; or (f) use the MCP in breach of any law or of the terms of any MCP client you use.
Beta, changes, keys and termination
The MCP is offered as a beta. We may change, add, remove, limit, suspend or withdraw any server, endpoint, tool, parameter, output, wording, allowance, cap, rate limit, data vintage, or the whole MCP, at any time, with or without notice, and we may revoke any key at any time, including for inactivity, for breach, or for no reason. Specifications and outputs may change between versions; the version is named in every answer.
We record every call to the MCP, including the key, the tool, the task class, the places resolved, the verdict and timing, and we use those records to operate the MCP, to meter use, to enforce these terms and to investigate suspected misuse. The monitoring, enforcement and indemnity provisions of the KASPR Schedule terms apply to the MCP, and you agree to indemnify KASPR Datahaus PTY LTD against any loss, damage, cost or claim arising from your use of the MCP in breach of these terms or from any action taken by an agent or client using your key.
Changes to these MCP terms
We may update these additional terms from time to time. The date at the top of this page is the date of the latest version. Continued use of a key after a change means you accept the changed terms.
