KASPR Data MCP: Additional Terms

Last updated 30 October 2026

These terms cover the KASPR Data MCP (mcp.kasprdata.com/data/mcp) and all data it returns. They add to the general terms for schedule.kasprdata.com at /terms-conditions.

1. Who and what

These terms are offered by KASPR Datahaus Pty Ltd (ABN 67 624 542 909), Prahran, Victoria, Australia ("KASPR"). They apply to the KASPR Data MCP server and to all data, figures, tables, series, rankings and other outputs it returns ("Data"). They add to KASPR's general terms; where the two conflict, these prevail for the Data. Using a key, directly or through any software agent or AI model, is acceptance of these terms by the person or entity the key was issued to ("you").

2. Licence

KASPR grants you a non-exclusive, non-transferable, non-sublicensable, revocable licence, for the term of your plan, to access the Data through your key and to use it for your own internal business analysis. All rights not expressly granted are reserved. KASPR owns the Data and all derivatives of it, to the extent derivatives reproduce or allow reconstruction of the Data.

3. What you must not do

You must not, and must not let any person, agent or model:

(a) sell, resell, license, sublicense, rent, lend, publish, distribute or otherwise make the Data available to any third party, whether in its original form or as part of a dataset, product, service, feed, API, dashboard or report, except as clause 4 permits;

(b) store, cache or retain the Data beyond 30 days after it was returned, except within internal work products (reports, memos, presentations) that contain only the figures needed for a specific analysis;

(c) compile, aggregate or accumulate Data across calls or keys to build, enrich or maintain a database, index, panel, time series or other collection, including by systematic or automated querying, enumeration of areas, companies or identifiers, or scraping;

(d) use the Data, or any output that contains or is derived from it, to train, fine-tune, distil, evaluate, benchmark or ground any machine-learning or AI model, or to place it in any retrieval index, vector store or memory that persists beyond the session in which it was returned;

(e) use the Data to build, improve or validate a product or service that competes with KASPR's, or to reverse engineer KASPR's methods, models, measurement network or sources;

(f) share, pool, lend or rotate keys, or use more keys than issued to you, or use a key from more agent deployments than KASPR has authorised;

(g) circumvent or attempt to circumvent any plan gate, row cap, rate limit, spread limit or other technical control, or access Data beyond your plan;

(h) use the Data to identify, profile, track or target any individual or household; to plan, facilitate or assess an attack on, or disruption of, any network, infrastructure or service; to support surveillance or censorship; or in breach of any sanctions, export-control or other applicable law;

(i) remove or alter the source attribution or `request_id` returned with the Data;

(j) present the Data as establishing the cause of any outage or disruption. The Data records timing, depth and shape; any cause must come from the public record.

4. Permitted publication

You may quote individual figures from the Data in your own publications (reports, articles, presentations, posts), provided the figures are incidental to your own analysis, are not a substantial part of the Data, and are attributed as "Source: KASPR Datahaus (pulse.kasprdata.com)". Any other external publication needs KASPR's prior written consent.

You may also share screenshots, images or charts of a single answer, as it was returned by the KASPR Data MCP or shown by your AI assistant, in your own posts, articles, presentations and social media, provided that each one is attributed as "Source: KASPR Datahaus (pulse.kasprdata.com)", shows no more than one answer, and is not part of a series, collection or feed that republishes the Data or a substantial part of it. KASPR may ask you to remove any image that, in its reasonable view, goes beyond this permission, and you must then remove it promptly.

5. AI providers and agents

You are responsible for every agent, model and provider you connect to the Data, as if each were you. You must use model providers and settings under which the Data is not used to train or improve the provider's models, and you must ensure that your agents comply with these terms. A breach by your agent or provider is your breach.

6. Third-party sources

Parts of the Data are derived from third-party sources, including GADM boundaries and the EM-DAT disaster database. Those sources' licence terms also apply. Where they restrict commercial use, you must comply with them, and KASPR may withhold the affected Data.

7. Monitoring and audit

KASPR logs each request and may monitor usage to enforce these terms. Each response carries an identifier that links it to your key. On 10 business days' notice (or immediately, if KASPR reasonably suspects a breach of clause 3), you must certify your compliance in writing, and you must give KASPR reasonable information about how the Data has been stored and used.

8. Suspension and termination

KASPR may throttle, suspend or revoke any key immediately and without notice if it reasonably suspects a breach of these terms, a security risk, or harm to its service. On termination or expiry, the licence ends, and within 10 business days you must delete all Data (other than permitted quotations under clause 4 and internal work products under clause 3(b)) and certify the deletion in writing on request.

9. No warranty

The Data is measured, modelled and provided "as is" and "as available". It may contain errors, gaps and revisions. It is not suitable as the sole basis for safety-critical, life-safety, emergency-response or investment decisions. To the maximum extent permitted by law, KASPR excludes all warranties, express or implied, including accuracy, completeness, fitness for a particular purpose and uninterrupted availability. Nothing in these terms excludes rights under the Australian Consumer Law that cannot be excluded. Where KASPR's liability for breach of such a guarantee can be limited, it is limited, at KASPR's option, to supplying the services again or paying for them to be supplied again.

10. Liability

To the maximum extent permitted by law: (a) KASPR is not liable for any indirect or consequential loss, or any loss of profit, revenue, data or goodwill; and (b) KASPR's total liability arising from the Data MCP is limited to the fees you paid for it in the 12 months before the claim (or AUD 100 if none).

11. Indemnity

You indemnify KASPR against any loss, liability, cost or claim (including reasonable legal costs) that arises from your breach of clauses 3, 5 or 6, or from any use of the Data by your agents or providers.

12. Remedies

A breach of clauses 3, 5 or 6 may cause KASPR irreparable harm for which damages would not be an adequate remedy. KASPR may seek injunctive or other equitable relief in addition to any other remedy. In addition, for each breach of clause 3(a), 3(c) or 3(d) you must pay KASPR a licence fee equal to KASPR's then-current list price for the Data improperly used, without prejudice to any other right.

13. Survival, changes and law

Clauses 2 (ownership), 3, 5–8 and 10–13 survive termination. KASPR may change these terms on 30 days' notice; continued use after that is acceptance. These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have exclusive jurisdiction.
